If you are a business entity, you also represent that you are duly authorized to do business in the country or countries where you operate; and your employees, officers, representatives, and other agents accessing the Services are duly authorized to access the Services and to legally bind you to the Terms and Condition of the Agreement.
By accepting this Agreement, you represent that you are eighteen years of age or older; or you affirm that you are at least the age (or the age of majority where you are located) at which you can enter into an agreement or possess legal parental or guardian consent to enter into the Agreement.
The Services that Chicbes provides are always evolving and the form and nature of the services that provides may change from time to time without prior notice to you We also retain the right to create limits on use and storage at our sole discretion at any time without prior notice to you In addition, Chicbes may stop (permanently or temporarily) providing the Services (or any features within the Services) to you or to users generally and may not be able to provide you with prior notice.
1.2 User Account
To use some of our Services, you must create an account with us When you create this account, you must provide accurate and up-to-date information It is important that you maintain and promptly update your details and any other information you provide to us, to keep such information current and complete We reserve the right to disable your user account at any time if in our reasonable opinion you have failed to comply with any of the provisions of the Terms and Conditions.

You agree that you are solely responsible (to us and to others) for the activity that occurs under your account If you know or suspect that any third party knows your password or has accessed your account, you must promptly notify us Chicbes cannot and will not be liable for any loss or damage arising from your failure to comply with the above account requirements.
You may delete your account at any time Basic accounts may be deleted from the Chicbes Service if they remain inactive (ie, the user fails to log in) for a continuous period of at least 24 months.
1.3 Services
Your use of the Services is subject to these Terms and Conditions and all applicable laws and regulations.
You may not:
Interfere with or attempt to interfere with the proper working of the Services, disrupt our website or any networks connected to the Services, or bypass any measures we may use to prevent or restrict access to the Services;
Modify, adapt, translate, revers engineer, disassemble, decompile or create any derivative works based on the Services, including any files, tables or documentation (or any portion thereof) or determine or attempt to determine any source code, algorithms, methods or techniques embodied the Platform or any derivative works thereof.
Distribute, license, transfer, or sell, in whole or in part, any of the Services or any derivative works thereof, rent or lease the Services for a fee or charge, or use the Platform to advertise or perform any commercial solicitation;
Impersonate any person or entity, or misrepresent or falsely state that you or your affiliation with any person or entity, including giving the impression that any content you distribute, post, upload, transmit, or otherwise make available emanates from the Services;
Incorporate the Platform or any portion thereof into any other program or product In such case, we reserve the right to refuse service, terminate accounts or limit access to the Services in our sole discretion;
Use or attempt to use another account, service or system without authorization from Chicbes, or create a false identity on the Services;
Use the Services in a manner that may create a conflict of interest or undermine the purposes of the Services, such as trading reviews with other users or writing or soliciting shill reviews;
1.4 Service Costs; Fees
It is currently free to access and browse the Chicbes websites, Apps and other aspects of the Services However, you may choose to purchase items through the Services, and you alone will be responsible for paying the purchase price of any items you buy, in addition to shipping costs and taxes Chicbes may limit or cancel quantities of items purchased, and it reserves the right to refuse any order In the event Chicbes needs to make a change to an order, it will attempt to notify you by contacting the email address, billing address, and / or phone number provided at the time the order was made Due to separate and applicable tax jurisdictions, the prices may be subject to changes, specific sales, use, customs or value-added taxes, and the shipping time and associated cost may increase accordingly As tax rules evolve, may be calculated and collected upon applicable laws and regulations.
1.5 Purchases; Pricing

Each final price of the item (s) is determined by or based on a price supplied by Chicbes offering an item for sale Chicbes provide the other information in the item listings, including any reference or strike-through prices Chicbes are obligated to provide accurate information, but we have no way to guarantee the truth or accuracy of information in item listings Chicbes does not represent, warrant, or guarantee that the Chicbes actually offered or sold the item at the strike-through price You should not rely on the strike-through price in connection with making any decision to purchase If comparison price is an important factor in your purchasing decision, you should do your own research and comparisons before making a purchase.
1.6 Refunds, Exchanges and Related
We want you to be satisfied with your purchase on the Services If you have a problem with an order or purchase, please contact us as described on our websites or apps You agree that: (i) Chicbes may, in accordance with its refund and returns policy, issue a refund to resolve any problems with your order, including the contents of an item listing or the item's delivery or condition; and (ii) if you wish to pursue any other remedy, you must seek that remedy directly from the applicable merchant Except as described in the terms of use of Chicbes, Chicbes cannot refund, reimburse, cover, or otherwise be responsible for any fees, including without limitation those not paid to Chicbes, such as customs, taxes as well as any return shipping costs you may incur in the refund process.
Return Process:
1. Please contact Customer Service on our APP with the item(s) you want to return and explain the reason.
2. After we apply the return request for you, please pack the items which you want to return with the original packaging.
3. Most returns will be processed within 5 working days after we receive your package.
Return Conditions:
1. You have 7 days to decide if the product is suitable for you, if you want to return it, please contact us within 7 days after receiving.
2. Returned items must be in unused condition with their original packaging. We do not accept return products that are worn, damaged, washed or altered in any way.
3. Most returns will be processed within 5 working days after we receive your package.
4. We do not accept returned items without a return request.
5. The following items are non-refundable:(Swimwear, Lingerie, Loungewear, Mommy Supplies, Maternity Wear, Baby Products & Accessories, Kids Toys, Flash Sale, Freebies.)
6. We currently only support returns and provide door-to-door pickup service in Kigali
7. You can get a full refund without dispute if:
① Wrong or missing items
② Damaged or stained items
③ The product size does not match the order
④ There is obvious color difference between the product and the picture

1.Refunds are only applicable to product returns, other charges such as shipping.

Chicbes makes no representations or guarantees, whether express or implied, that any Chicbes Content is accurate, complete or up to date All Chicbes content, whether publicly uploaded or privately posted, is the sole responsibility of the user who originated such content We have no control over the contents of those sites or resources Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them Any use or reliance on any content or materials posted via the services or obtained by you through the services is at your own risk We do not take responsibility for such content.
Subject to the Terms and Conditions, you are hereby granted a non-exclusive, limited, non-transferable, non-sublicensable, revocable license to use the services, including to download the platform on a permitted device, and to access the Chicbes Content through your use of the Services Chicbes reserves all rights not expressly granted herein in the Services and the Chicbes Content You acknowledge and agree that Chicbes may terminate this license at any time for any reason or no reason.
The Chicbes Content or materials on the Services for any purpose not expressly permitted by the Terms and Conditions is strictly prohibited Such content may not be downloaded, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed or otherwise exploited for any purpose whatsoever without our or, where applicable, our licensors' prior written consent We and our licensors reserve all rights not expressly granted in and to their content It being understood between you and Chicbes that you or your licensors will own any User Content (as defined below) you upload or transmit through the Services.
Under no circumstances will Chicbes be liable in any way for any content, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of any content posted, emailed , transmitted or otherwise made available via the services or broadcast elsewhere.
You understand that by using the services, you may be exposed to content that might be offensive, harmful, inaccurate or otherwise inappropriate, or in some cases, postings that have been mislabeled or are otherwise deceptive You acknowledge and agree that when you view content provided by others on the Services, you are doing so at your own risk The content on our Services is provided for general information only It is not intended to amount to advice on which you should rely You must obtain a professional or specialist advice before taking, or refraining from, any action on the basis of the content on our services\
The Services may include advertisements, which may be targeted to the Content or information on the Services, queries made through the Services, or other information The types and extent of advertising by Chicbes on the Services are subject to change In consideration for Chicbes granting you access to and use of the Services, you agree that Chicbes and its advertising providers and partners may place such advertising on the services or in connection with the display of content or information from the services whether submitted by you or others .
1.8 User-Generated Information
Users may be permitted to upload, post or transmit any views, comments, feedback and information and / or data or express views through the Services (the “User information”)The User information on our Platform do not represent our views or values Whenever you upload or transmit User information through the Services, or to make contact with other users of the Services, you must comply with the standards set out in the Agreement.
You agree and represent that you own the User information, or you have received permission from, or are authorized by, the owner of any part of the information to submit it to the Services You warrant that your User information is not invasive of another's privacy, offensive, defamatory of any party or individual or illegal You warrant that your User information does not infringe any patent, trademark, trade secret, copyright, or other intellectual or proprietary.
You may not upload, post, or transmit (collectively, "submit") any information, image, text, audio recording, video or other work that is:
Any information, material which contain viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful;
Any information, material which intimidate another, or promote sexually explicit material, violence, obscene, offensive, hateful or inflammatory discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;
Any information, material which does or may infringe any copyright, trade mark or other intellectual property or privacy rights of any other person;
Any private information of any third party, including addresses, phone numbers, email addresses, number and feature in the personal identity document (eg National Insurance numbers, passport numbers) or credit card numbers;
We reserve the right, at any time and without prior notice, to expeditiously remove any information, content from or disable access to our services for any reason or no reason It is Chicbes policy, in appropriate circumstances and at its own discretion, to disable or terminate the accounts of users of the services who repeatedly infringe copyrights or intellectual property rights of others Some of the reasons we may remove or disable access to content may include finding the content objectionable, in violation of the Agreement or otherwise harmful to the Services or our users.
1.9 License
As between you and Chicbes, you own the User Information, that you submit or post to the Chicbes Platform By submitting or sharing such information, you grant Chicbes and its affiliates or its partner a limited, worldwide, non-exclusive, royalty-free license and right to copy, transmit, distribute, publicly perform and display (through all media now known or hereafter created), and make derivative works from the User Information for the purpose of (i) displaying within the Chicbes platform, (ii) promoting the Service, provided that you have made the User Information publicly available; and (v) archiving or preserving the User Information for disputes, legal proceedings, or investigations This license is for the purpose of enabling you to use and enjoy the benefit of the Services as provided by Chicbes.
We may modify or adapt the User Information in order to transmit, display or distribute it over networks and in various manners and / or make changes to the User Information as are necessary to conform and adapt the User Information to any requirements or limitations of any networks , devices, Services or media of Chicbes.
You further grant all users of the Chicbes Service permission to view your information for their personal, non-commercial purposes The foregoing licenses are in addition to any license you may decide to grant (eg, a Creative Commons license).
The above licenses will continue unless and until you remove your User Information from the Chicbes Service, in which case the licenses will terminate within a commercially reasonable period of time Notwithstanding the foregoing, the license for legal archival / preservation purposes will continue indefinitely.
1.10 Intellectual Property Rights

We reserve the right to remove the content alleged to be infringing intellectual property right without prior notice and at our sole discretion In appropriate circumstances, Chicbes will also terminate a user's account if the user is determined to be a repeat infringer.
1.11 Indemnity
You agree to indemnify, defend and hold harmless Chicbes, Facility Provider and their subsidiaries, affiliates, and its and their directors, officers, owners, agents, co-branders or other partners, employees, information providers, licensors, licensees, consultants, contractors and other applicable third parties (collectively "Indemnified Parties") from and against any and all claims, demands, causes of action, debt or liability, including reasonable attorney fees, including without limitation attorney fees and costs incurred by the Indemnified Parties arising out of , related to, or which may arise from:
(a) your use of the Services under this Agreement;
(b) any breach or non-compliance by you of any term of this Agreement or any other third parties' policies;
(c) any dispute or litigation caused by your actions or omissions; or
(d) your negligence or violation or alleged violation of any Applicable Law or rights of a third party.
1.12 Limitation of Liability
your access to and use of the services or any content is at your own risk you understand and agree that the services is provided to you on an "as is" and "as available" basis without limiting the foregoing, Chicbes entities disclaim all warranties and conditions, whether express or implied, of merchantability, fitness for a particular purpose, or non-infringement.
Chicbes entities make no warranty and disclaim all responsibility and liability for: (i) the completeness, accuracy, availability, timeliness, security or reliability of the services or any content; (ii) any harm to your computer system, loss of data, or other harm that results from your access to or use of the services, or any content; (iii) the deletion of, or the failure to store or to transmit, any content and other communications maintained by the services; (iv) whether the services will meet your requirements or be available on an uninterrupted, secure, or error-free basis no advice or information, whether oral or written, obtained from Chicbes entities or through the services, will create any warranty not expressly made herein(v) in no event shall Chicbes be liable to you for indirect, special, incidental, consequential, exemplary, or punitive damages.
1.13 Ending the Agreement
The Terms will continue to apply until terminated by either you or Chicbes as follows You may end your legal agreement with Chicbes at any time for any reason by deactivating your accounts and discontinuing your use of the Services We may suspend or terminate your accounts or cease providing you with all or part of the Services at any time for any reason, including, but not limited to, if we reasonably believe: (i) you have violated the Terms and Conditions, (ii ) you create risk or possible legal exposure for us; or (iii) our provision of the Services to you is no longer commercially viable We will make reasonable efforts to notify you by the email address associated with your account or through the Services the next time you attempt to access your account.
In all such cases, the Terms and Conditions shall term, including, without limitation, your license to use the Services, except that the following sections shall continue to apply: 1.11, 1.12, 1.13 and nothing in this section shall affect the rights of Chicbes to change, limit or stop the provision of the Services without prior notice.

These Terms constitutes the whole legal agreement between you and Chicbes and govern your use of the services (excluding any services for which you have a separate agreement with Chicbes that is explicitly in addition or in place of these terms), and these terms supersede and completely replace any prior agreements between you and Chicbes regarding the Services.
